DMCA & Copyright Policy
Last updated: November 07, 2026
1. Overview & Safe Harbor Commitment
NammaTamil ("the Platform") operates as an online community portal and service provider under Title II of the Digital Millennium Copyright Act (17 U.S.C. § 512, "DMCA"), the Indian Information Technology Act, 2000 (including Intermediary Guidelines and Digital Media Ethics Code Rules, 2021), and comparable international Safe Harbor protections.
Certain modules across our portal—including Wallpapers, Ringtones, Memes, Stickers, Lyrics, Poems, Books, Quotes, Recipes, and Community Submissions—allow registered users to upload, publish, and share media. We do not preview or verify the copyright status of every user submission prior to publication. However, we respect intellectual property rights and respond expeditiously to legitimate notices of alleged copyright infringement.
2. Automated Removal System (Recommended)
To streamline takedown claims and ensure rapid turnaround, every user-uploaded page across all 26 content modules on NammaTamil includes an integrated removal request widget.
When you locate unauthorized material on the platform, click the "Request Removal" button directly in the item header or Safe Harbor card on the show page. Submitting this form automatically logs a compliance ticket (e.g. DMCA-YYYYMMDD-XXXXXX) directly into our moderation queue, timestamps the claim, and notifies our compliance team for immediate review within 24 to 48 hours.
3. Statutory DMCA Notice Requirements
If you prefer not to use our automated widget and wish to submit a written notice pursuant to 17 U.S.C. § 512(c)(3), your notification must contain all of the following statutory elements:
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of Original Work: Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of Infringing Material: Direct URLs on NammaTamil identifying the specific content to be removed or disabled.
- Contact Information: Information reasonably sufficient to contact you, including your legal name, physical address, telephone number, and email address.
- Good Faith Statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
4. Designated Copyright Agent & Grievance Officer
Formal legal notices and communications under the DMCA or Indian Intermediary Guidelines Rule 3(2) should be directed to our designated compliance office:
5. Counter-Notification Procedure
If you are a registered user who uploaded material that was disabled or removed due to a mistaken or misidentified copyright claim, you may submit a formal Counter-Notification pursuant to 17 U.S.C. § 512(g)(3).
Your counter-notification must be in writing sent to our Designated Agent and must contain:
- Your physical or electronic signature.
- Identification of the material removed and the URL location prior to removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your legal name, address, telephone number, and email address.
- A statement consenting to jurisdiction of the appropriate federal or competent civil court, and agreeing to accept service of process from the original claimant.
Upon receipt of a valid counter-notification, we will promptly forward it to the original claimant. Unless the claimant files a legal action seeking a court order within 10 to 14 business days, we may restore the removed content in accordance with § 512(g)(2)(C).
6. Repeat Infringer Policy
In strict compliance with 17 U.S.C. § 512(i)(1)(A), NammaTamil enforces an uncompromising repeat infringer policy. We track takedown requests and account violations.
Users who receive repeated valid copyright infringement notices will have their accounts suspended or permanently terminated, and their ability to upload, contribute, or publish content revoked without prior notice.
7. Misrepresentation Penalties
Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to severe liability for statutory damages, including attorneys' fees incurred by the alleged infringer, copyright owner, or service provider.
8. External Links & Embedded Media
Certain sections of our service (such as YouTube Channels, Movie Trailers, and Radio Station stream directories) embed or link to content hosted on third-party platforms (e.g. YouTube, Vimeo, internet streaming servers). For material hosted on external platforms, copyright takedown requests must be served directly to the hosting provider where the underlying stream or file is stored.
